Host agreement

1. Independent Host Status

Host is an independent contractor and not an employee, agent, joint venturer, or partner of CourtShare LLC.

Nothing in this Agreement creates an employment or agency relationship.

2. Authority to List Property

Host represents and warrants that they are the legal owner or lawful occupant of the Property and have full authority to list it on the Platform.

Host is solely responsible for compliance with all applicable laws, zoning requirements, lease terms, and HOA rules.

3. Insurance Requirement

Host represents and warrants that they maintain active homeowner’s or property liability insurance covering the listed premises.

Host agrees to maintain such insurance during all periods the Property is listed on the Platform.

Host agrees to provide proof of insurance upon request.

4. Property Safety & Maintenance

Host is solely responsible for the condition, safety, and maintenance of the Property, including court surfaces, fencing, lighting, equipment, and surrounding areas.

Host acknowledges and agrees that:

- CourtShare does not control how the Property is used or maintained

- CourtShare does not inspect, monitor, or verify the condition or safety of any Property

- CourtShare makes no representations or warranties regarding the safety or suitability of the Property

Host further agrees to maintain the Property in a reasonably safe condition and to comply with all applicable laws and safety requirements.

Host acknowledges that users access and use the Property at their own risk and agrees that CourtShare shall not be responsible for any injuries or incidents occurring on the Property.

5. Indemnification

Host agrees to indemnify, defend, and hold harmless CourtShare LLC and its members, managers, officers, employees, and agents from any claims, damages, losses, or expenses arising out of the condition of the Property, Host’s negligence or misconduct, violation of laws or HOA rules, or claims brought by Players or third parties.

6. Platform Fees & Payments

Host agrees to the platform fee structure displayed in the Host dashboard.

CourtShare may deduct applicable fees before remitting payout amounts.

7. Limitation of Liability

To the fullest extent permitted by law, CourtShare shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Total liability of CourtShare shall not exceed platform fees collected from Host during the twelve (12) months preceding the claim.

8. Mandatory Arbitration & Jury Trial Waiver

ANY DISPUTE ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN VENTURA COUNTY, CALIFORNIA.

HOST AND COURTSHARE WAIVE ANY RIGHT TO A TRIAL BY JURY.

Class and representative actions are waived.

9. Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

10. Entire Agreement

This Agreement constitutes the entire agreement between Host and CourtShare regarding listing of the Property and supersedes any prior agreements.

11. Modifications

CourtShare may modify these policies at any time. Continued use of the Platform constitutes acceptance of the updated policy.
