1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”) and CourtShare LLC, a California limited liability company (“CourtShare”).
By accessing or using the CourtShare website (“Platform”), you agree to be bound by these Terms.
2. Nature of the Platform
CourtShare operates an online marketplace connecting property owners or lawful occupants (“Hosts”) with individuals seeking to reserve private pickleball courts (“Players”).
CourtShare does not own, lease, manage, or control any listed Property and is not responsible for the condition, safety, or legality of any Property.
All bookings are agreements directly between Player and Host.
3. Eligibility
You must be at least 18 years old to create an account or book a reservation.
You agree to provide accurate and complete information and to maintain the security of your account credentials.
4. Bookings and Payments
Players authorize CourtShare to process payments and collect applicable service fees.
The service fees applicable to the Platform may be revised, modified, or otherwise adjusted at any time.
Hosts are responsible for setting pricing and cancellation policies displayed on their listings.
CourtShare may facilitate payment collection and distribution but is not a party to the rental agreement between Player and Host.
5. Host Responsibilities
Hosts represent and warrant that they have legal authority to list the Property.
Hosts agree to maintain active homeowner’s or property liability insurance covering the listed premises.
Hosts are responsible for compliance with local laws, zoning requirements, and HOA rules.
6. User Conduct
Users agree not to exceed booking capacity, violate House Rules, circumvent the Platform to avoid fees, or engage in unlawful or disruptive behavior.
CourtShare may suspend or terminate accounts for violations of these Terms.
7. Intellectual Property
All Platform content, design, software, and technology are owned by CourtShare LLC.
You may not copy, reproduce, modify, reverse engineer, or distribute Platform content without written permission.
8. Disclaimer of Warranties
The Platform is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied.
CourtShare disclaims all implied warranties including merchantability and fitness for a particular purpose to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, CourtShare shall not be liable for indirect, incidental, consequential, special, or punitive damages.
Total liability of CourtShare shall not exceed the amount paid for the booking giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless CourtShare LLC and its members, managers, officers, employees, and agents from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or conduct on a listed Property.
11. Mandatory Arbitration & Jury Trial Waiver
ANY DISPUTE ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE PLATFORM SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN VENTURA COUNTY, CALIFORNIA.
YOU AND COURTSHARE WAIVE ANY RIGHT TO A TRIAL BY JURY.
Class, representative, and private attorney general actions are waived.
12. Governing Law
These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
13. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between you and CourtShare regarding use of the Platform and supersede any prior agreements or understandings.
15. Modifications
CourtShare may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
